Welcome to the Immy Hathaway Artwork website. By accessing this website or placing an order, you agree to these Terms & Conditions. Please read them carefully before making a purchase.

1. About Us

Immy Hathaway Artwork is a UK sole trader creating and selling original artwork, prints, sculptures, miniatures, jewellery, and commissioned artwork.

Throughout these Terms & Conditions, "we", "us" and "our" refer to Immy Hathaway Artwork. "You" refers to the customer purchasing goods or using this website.

2. Products

We take great care to describe and photograph our artwork as accurately as possible.

As each screen displays colour differently, slight variations between the images shown on this website and the actual artwork may occur.

Many of our products are handmade. Small variations in colour, texture, finish or size are part of the character of handmade artwork and should not be considered faults.

3. Original Artwork

Original artworks are unique, one-of-a-kind pieces.

Once sold, an original artwork will no longer be available unless otherwise stated.

Where applicable, original artworks may be supplied with a Certificate of Authenticity.

4. Prints

Prints may be offered as either open editions or limited editions, as stated in the individual product description.

Frames shown in photographs are for display purposes only unless specifically included in the product description.

5. Sculptures, Miniatures and Jewellery

Each handmade piece is individually created.

Minor differences between pieces are to be expected and contribute to the uniqueness of handmade work.

Customers are responsible for following any care instructions provided with their purchase.

Jewellery should be handled with care and kept away from young children where small parts may present a choking hazard.

6. Prices

All prices are shown in Pounds Sterling (£).

Prices may change without notice, but any changes will not affect orders that have already been accepted.

Delivery charges, where applicable, will be displayed during checkout before payment is completed.

7. Payment

Payment must be received before goods are dispatched.

We accept payment using the methods offered during checkout.

We reserve the right to refuse or cancel an order if payment cannot be authorised or if fraudulent activity is suspected.

8. Order Acceptance

After placing an order, you will receive an order confirmation.

This confirmation acknowledges receipt of your order but does not guarantee acceptance.

A contract is formed once your order has been accepted and payment has been successfully processed.

If an item becomes unavailable before dispatch, we will contact you as soon as possible to offer a replacement, an alternative product, or a full refund.

9. Delivery

We aim to dispatch orders within the estimated times shown on the website.

Delivery times are estimates and cannot be guaranteed.

We are not responsible for delays caused by postal services, customs authorities, severe weather or circumstances beyond our reasonable control.

Risk in the goods passes to you when your order is delivered.

Ownership of the goods transfers to you once payment has been received in full.

10. International Orders

Where international delivery is available, customers are responsible for any customs duties, import taxes or local charges imposed by their country.

We cannot accept responsibility for delays caused by customs clearance.

11. Returns and Cancellations

Your rights under UK consumer law are not affected by these Terms & Conditions.

Please refer to our Returns & Refunds Policy for full details of cancellations, returns and refunds.

Personalised or commissioned artwork may not be eligible for cancellation or return once work has begun, except where required by law.

12. Commissions

Commissioned artwork is subject to separate Commission Terms & Conditions.

A quotation does not guarantee availability.

Work on a commission will only begin once both parties have agreed the project and any required deposit has been received.

13. Copyright and Intellectual Property

All artwork, photographs, images, designs, text and content on this website remain the intellectual property of Immy Hathaway Artwork unless otherwise stated.

Purchasing artwork does not transfer copyright.

Unless agreed in writing, customers may not:

Copy or reproduce the artwork.
Scan or photograph artwork for commercial purposes.
Produce prints or merchandise from the artwork.
Use the artwork commercially.
Alter or modify the artwork for commercial use.

Images displayed on this website may not be copied or reproduced without prior written permission.

14. Website Content

We make every effort to ensure the information on this website is accurate.

However, we reserve the right to correct errors, inaccuracies or omissions at any time without prior notice.

We may update or discontinue products without notice.

15. Limitation of Liability

Nothing in these Terms & Conditions limits or excludes liability where it would be unlawful to do so.

Subject to applicable law, Immy Hathaway Artwork shall not be liable for any indirect, incidental or consequential loss arising from the use of this website or the purchase of goods.

Our total liability shall not exceed the purchase price of the goods concerned.

16. Privacy

Your personal information will be handled in accordance with our Privacy Policy.

We only collect and use your information as necessary to process orders, respond to enquiries and comply with legal obligations.

17. Events Beyond Our Control

We shall not be liable for delays or failure to fulfil our obligations where this results from events outside our reasonable control, including but not limited to:

Severe weather
Postal disruption
Industrial action
Fire
Flood
Pandemic
Government restrictions
Supply shortages

18. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales unless consumer protection law provides otherwise.
